Navsports is intended for general audiences. Parents and guardians who permit their children to use Navsports should supervise such access to Navsports by minors and are responsible for ensuring that the Content is suitable for those children. Such Content may not specifically be intended to be accessed by children.

You understand that the Service and the Web site are available for your personal, non-commercial use only (Registered sports team/leagues and or sporting Organization profiles are exempt from the non-commercial use clause). You represent, warrant and agree that no materials of any kind submitted through your account will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material. You further agree not to harvest or collect email addresses or other contact information of Members from the Service or the Web site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Service or the Web site or for any other purpose. You further agree that you may not use the Service or the Web site in any unlawful manner or in any other manner that could damage, disable, overburden or impair this Web site. By posting Member Content to any part of the Web site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, perform, display, reformat, translate, excerpt (in whole or in part) and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

You may remove your Member Content from the Web site at any time. If you choose to remove your Member Content, the license granted above will automatically expire.

You can follow an unlimited number of Teams, Leagues or Organizations (TLO) on the Navsports website. You have not actually joined the (TLO), but are only associated with them on the Navsports website. To follow simply view the (TLO) profile and click on the "Follow this Team/Organization" button, when you do this your Fan profile will appear on the (TLO) profile. By Following a (TLO) you automatically agree to receive emails from this (TLO).".
Navsports Members have the right to unfollow any (TLO) at any time, and (TLO`s) have the right to delete any Follower at any time.

The Navsports Web site contains Embedded Videos and links to other web sites. Navsports, Inc. is not responsible for the content, accuracy or opinions express in such web sites, and such web sites are not investigated, monitored or checked for accuracy or completeness by Navsports, Inc. Inclusion of any Embedded video and or linked web site on or through the Navsports Web site or the Service does not imply approval or endorsement of the linked web site by Navsports, Inc. If you decide to leave the Web site and access these third-party sites, you do so at your own risk.

You are solely responsible for your interactions with other Navsports.com Members. We reserve the right, but have no obligation, to monitor disputes between you and other Members.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

By visiting or using the Web site and/or the Service, you agree that the laws of Australia, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and Navsports. or any of its affiliates.

Any dispute relating in any way to the Web site and/or the Service (including your visit to or use of the Web site and/or the Service) shall be submitted to confidential arbitration NSW, Australia, except that, to the extent you have in any manner violated or threaten to violate Navsports, Inc. or any of its affiliates' proprietary or intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court of competent jurisdiction. For the purpose of such relief, you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, non-exclusive venue and jurisdiction in the state of New South Wales.

Arbitration under this Agreement shall be conducted under the rules then prevailing of the Australian Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms and Conditions shall be joined to an arbitration involving any other party subject to these Terms and Conditions, whether through class arbitration proceedings or otherwise. Any claim, action or proceeding by you related in any way to the Web site and/or the Service (including your visit to or use of the Web site and/or the Service) must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

You agree to indentify and hold Navsports, Inc. its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, or demand, including reasonable attorney's fees, arising out of any claim, action, investigation or proceeding made or instituted by any third party due to or arising out of your use of the Service or the Web site in violation of this Agreement or your violation of any law or the rights of a third party.

Sports Fans - Followers

1. Its pretty simple, you as a Sports Fan can FOLLOW any Team/League or Organization listed in the Navsports National Directory.


2. If that Team/League or Organization has a small badge with NAVPOINTS REWARDS MEMBER on the top right of the page, you will start receiving discount vouchers to use at that Team/League or Organization if you are a follower.


3. Discounts range from 5%, 10%, 15%, 20% and 25% off Products or Services at that Team/League or Organization.


4. Just by FOLLOWING a Team/League or Organization you will get a 5% voucher straight away.


5. When you interact with the Navsports website i.e., adding friends, uploading photos, submitting articles and so on. You will get NavPoints which add up to great discounts vouchers to be used at participating Teams/Leagues or Organizations.  Check out NavPoints Leader Board here.


6. Print the voucher you receive by email, and then take it along to the Team/League or Organization to get your discount. It’s that simple.


7. You can only redeem each discount voucher once, a verification email will be sent to the Team/League or Organization you are following corresponding to the voucher you received in your email.


8. Teams/Leagues/Organizations may place restrictions on which Products or Services the vouchers can be used on, but Teams/Leagues and Organizations are subject to Navsports Fair Play rules to make sure you get good value.


9. As an individual user you are also bound by Navsports Fair Play rules regarding the NavPoints vouchers.


10. NavSports Fair Play means you are obligated to respect a Team/League/Organizations restriction on the Products and services that they wish the NavPoints vouchers to be used on.


11. Furthermore NavSports Fair Play rules extend to you as a User that you can only redeem once each of the levels of discounts that the vouchers are issued for; they are a 5%, 10%, 15%, 20% and %25 discount off a Product or Service. If you try to manipulate, corrupt or misuse these discount vouchers in any way you may have your Navsports user account deleted without warning and thus lose all of your NavPoints accumulated.


12. Any complaints about a Team/League/ and Organization can be registered by email here.

Teams / Leagues / Organizations.

1. Get more people using your products and services by becoming a NavPoints Rewards Member.


2. By opting in to the NavPoints Rewards program you are giving hundreds more people the incentive to try your business out.


3. When you register your Team/League or Organization on the Navsports website you can select to become a Rewards Member, if you do a badge will appear on your Team/League or Organization page. See example here


4. For each voucher issued to a Navsports user a corresponding email will be sent to you to verify the voucher. That way it can only be used once.


5. If a Navsports user presents a NavPoints discount voucher you will be obligated to honor the discount amount indicated on the voucher when presented to your Team/League or Organization.


6. You may place restrictions on which Product or Service the voucher can be used for, but you are obligated under Navsports Fair Play rules to be fair, remember you have a new or existing customer utilising your Products or Services so you want to keep them happy and coming back again.


7. If you want to place restrictions on what the vouchers can be used for, we suggest you have this printed and made available at your business for your new or existing customers to view.


8. You can opt out of the NavPoints Rewards program at any time but you are obligated to honor any outstanding vouchers issued prior to opting out.


9. NavSports Fair Play means you as a Team/League/Organization must act in good faith when dealing with holders of a NavPoints rewards Voucher. You must clearly display what Products and Services a Navsports Discount voucher can be used on upon at your place of business.


10. If you as a Team/League/Organization do not act in good faith when dealing with a holder of a NavPoints rewards voucher you may have your account deleted without warning.


11. Any complaint about a Navsports User can be made by email here.

 

These Terms and Conditions, together with the Privacy Policy and any other policies of the Company posted by us on the Web site, constitute the entire agreement between you and Navsports, Inc. regarding the use of the Web site and/or the Service, superseding any prior agreements between you and Navsports, Inc. relating to your use of the Web site or the Service. The failure of Navsports, Inc. to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
